Although Arizona does not currently have a state False Claims Act, whistleblowers in the state may still pursue an action under the federal False Claims Act for false claims submitted to obtain payment or other compensation from the federal government.

Many False Claims Act violations impact multiple states and an allegation under the federal False Claims Act may seek recovery for fraud against the federal government in conjunction with state law claims.

Recently, the state has considered proposed legislation which would create a state False Claims Act enabling recovery and imposition of civil penalties for false claims made against the state government. House Bill 2844, currently pending before the Arizona state legislature, would bring Arizona within the majority of states with a state False Claims Act.

This information is believed to be current and up to date as of July, 2013. Nonetheless, attorneys and qui tam relators should rely on the most up to date version of the state’s laws.
